NETWORK CABLING & HARDWARE DISCLAIMER

As CAPA's software is being installed on all or some customer provided equipment and network wiring, CAPA will not be responsible for the suitability, readiness, repair, upgrade or configuring of some customer's equipment nor the testing/certification of the network cabling. If CAPA performs any of the above labor, the customer will automatically be obligated to pay for that service and will submit payment immediately upon receipt of an invoice for that service. The customer agrees to pay for any travel and per diem costs incurred by CAPA and CAPA personnel, or CAPA's agent/representative, if the customer's equipment, personnel or agents are not available for CAPA to proceed with the contracted services.

CAPA will not accept any liability for the original equipment or network cabling before and after CAPA performs any of the above mentioned services.

In the case of network cabling, CAPA requests that a representative of the vendor provide certification that the cabling was performed to the specifications of LANTASTIC and CAPA, and be available to perform the modification and connections necessary for CAPA to proceed with the software installation and the setup of the NetWare consistent with the requirements of CAPA's software.

HARDWARE DISCLAIMER

As the software is being installed on customer provided equipment and/or existing phone equipment, CAPA will not be responsible for the suitability, readiness, repair, upgrade or configuring of customer's equipment nor the configuring of the call data transmission line. If CAPA performs any of the above labor, the customer will automatically be obligated to pay for that service and will submit payment immediately upon receipt of an invoice for that service. The customer agrees to pay for any travel and per diem costs incurred by CAPA and CAPA personnel, or CAPA's agent/representative, if the customer's equipment, personnel or agents are not available for CAPA to proceed with the contracted services.

In the case of customer phone equipment, CAPA requests that a representative of the vendor for that equipment be available to perform the modification and connections necessary for CAPA to proceed with the software installation and the call accounting connections and interfacing.
